0. Definitions

  • ELENDE: ELENDE – Tecnologias de Informação, Lda. (“ELENDE”, “Provider”).

  • Customer/Subscriber: the individual or legal entity purchasing Services.

  • Services: shared web hosting, related email, domain registration/management, virtual/cloud servers (VPS/Cloud), dedicated servers, and related services.

  • AUP: Acceptable Use Policy.

  • Customer Portal: ELENDE’s online client area.

  • Past Due / Default: any overdue payment amounts.


1. General Terms

1.1 Acceptance

By ordering or using any Service, Customer agrees to these Terms, the AUP and all applicable policies/attachments, which together form the minimum agreement for service provision.

1.2 Amendments

ELENDE may update these Terms/policies at any time by publishing an updated version. Continued use of Services after publication constitutes acceptance of the updated Terms.

1.3 Refusal / Non-renewal

ELENDE may refuse, suspend, cancel or decline renewal of Services due to operational, legal, risk, fraud, non-compliance, abusive usage or technical/commercial incompatibility. Where applicable, ELENDE may refund unused prepaid amounts, except where refusal/termination results from breach, fraud, or unlawful activity.

1.4 Prepayment

Services are generally provided on a prepaid basis unless otherwise agreed in writing.

1.5 Legal Requests

ELENDE may disclose Customer data to competent authorities upon valid legal request, as required by applicable law.

1.6 Non-compliance

Breach of these Terms/AUP may lead to suspension, termination, cancellation and/or legal action, without prejudice to ELENDE’s right to collect amounts due.

1.7 Maintenance

ELENDE may interrupt Services for maintenance, upgrades, security actions, incident mitigation or force majeure. ELENDE will use reasonable efforts to provide notice where practical.

1.8 Prohibited Activities

Customer must not use Services for spam, malware, phishing, copyright infringement, unlawful content, criminal facilitation, DoS/DDoS, brute force, abusive bots, exploitation, or any activities illegal under the laws of the Republic of Angola and applicable international law.

1.9 Strictly Prohibited Content

Illegal content is strictly prohibited, including child sexual exploitation material, hate/incitement, terrorism-related content, fraud, and malicious hacking content.

1.10 Indemnity

Customer shall indemnify and hold ELENDE harmless against claims, damages, penalties, costs and expenses arising from Customer’s breach, misuse, unlawful activity, or abusive consumption requiring extraordinary interventions.


2. Non-Payment, Suspension, Termination & Data Deletion (Critical)

2.1 Failure to pay by the due date constitutes payment default, and ELENDE may automatically suspend the affected Service without court notice.

2.2 After suspension, any retention of Customer data is purely operational courtesy, without warranty and without any obligation to preserve data.

2.3 Thirty (30) consecutive days after the suspension date due to non-payment, if all outstanding amounts remain unpaid, ELENDE may permanently terminate the Service and perform complete, permanent and irreversible deletion of all data associated with the Service, including files, databases, emails, backups, snapshots and configurations.

2.4 Customer expressly acknowledges that, following permanent termination, data recovery may be impossible, and ELENDE shall not be liable for data loss, loss of profit, loss of business, or any indirect or consequential damages.

2.5 Customer is solely responsible for maintaining independent and up-to-date backups for all Services, including shared hosting, VPS/Cloud and dedicated servers.

2.6 Any post-termination recovery attempt (if technically possible) is not guaranteed and may be subject to prior quotation and administrative/technical fees.


3. Shared Web Hosting

3.1 Customer is solely responsible for hosted content; ELENDE does not proactively review all content.

3.2 Resale/sublease is prohibited except through reseller plans expressly offered.

3.3 Email sending limits apply (e.g., 500 emails/hour per hosting account or as published). Bulk email requires appropriate specialized services.

3.4 Excessive resource consumption (CPU/RAM/IO/processes/inodes) affecting stability may result in suspension. ELENDE may suspend without prior notice and notify within a reasonable timeframe.

3.5 P2P/Bittorrent/warez and copyright-infringing file sharing are prohibited.

3.6 Large file hosting may require prior approval (e.g., files over 100MB or as published).

3.7 Overages may be charged if published limits are exceeded.

3.8 Shared hosting must not be used as general backup storage unrelated to the website.

3.9 Hotlinking/media hosting for third-party sites is prohibited.

3.10 Abusive database queries that destabilize the environment are prohibited; ELENDE may limit or terminate such processes.

3.11 Backup eligibility limits may apply (e.g., 20GB and/or 100,000 inodes).

3.12 Inode limits apply (e.g., 250,000 or as published) and may result in suspension if exceeded.


4. Domains

4.1 Customer represents domain usage will not violate laws or third-party rights.

4.2 Domain registration/renewal/transfer fees are generally non-refundable due to third-party registrar/registry costs and the personalized nature of domain services.

4.3 Customer must inform any transferee/reseller of applicable terms/policies.

4.4 ELENDE’s liability for domain services is limited to the amounts paid for the specific domain service.

4.5 Domain services are subject to registrar/registry policies; in case of conflict, registry rules prevail.

4.6 Dispute policies may apply (e.g., UDRP/URS or TLD-specific policies).

4.7 ELENDE is not liable if a domain is registered by a third party before payment confirmation/provisioning.

4.8 Sunrise/landrush/pre-order phases may involve auctions/disputes; no allocation guarantee.

4.9 DNS misconfiguration by Customer is Customer’s responsibility.

4.10 Non-payment may result in domain lock preventing use/transfer until full settlement.

4.11 Redemption/restoration may involve registry fees and strict deadlines depending on the TLD.


5. VPS/Cloud & Dedicated Servers

5.1 Customer is responsible for server administration and security unless a managed service is explicitly purchased.

5.2 Unlawful and abusive activities are prohibited.

5.3 ELENDE is not liable for damages arising from third-party software, external attacks, or events beyond ELENDE’s control.

5.4 Customer is solely responsible for backups; optional snapshots/backups are not guaranteed unless expressly contracted with specific SLA.

5.5 Hardware replacement for rented dedicated hardware will be performed within a reasonable timeframe subject to availability.

5.6 ELENDE may immediately suspend/terminate Services for serious breach or security/network risk.


6. Backups

6.1 Any backups on shared services may be provided as a courtesy and are not guaranteed.

6.2 ELENDE is not liable for data loss caused by force majeure or circumstances beyond its reasonable control.

6.3 Backup tools may be provided; Customer should maintain independent backups.

6.4 Backup limitations may apply (size/inodes/policies).

6.5 ELENDE-provided backups do not constitute a contractual guarantee and may be modified/removed without notice.


7. Billing & Payments

7.1 Customer must provide accurate billing data; ELENDE is not liable for errors in Customer-submitted information.

7.2 Invoices are issued based on Customer Portal data.

7.3 Services are provisioned upon payment confirmation.

7.4 ELENDE may change pricing and offers; Customer must verify renewal pricing.


8. Upgrades/Downgrades

Upgrades/downgrades may be available subject to technical feasibility and published policies, including prorations/credits.


9. Affiliate Program

Affiliate participation is subject to published rules; abuse/fraud may lead to termination and forfeiture of illegitimate commissions.


10. Notifications

ELENDE may send notifications (email/SMS). Delivery is not guaranteed. Non-payment handling follows Section 2 regardless of notifications.


11. Cancellation & Refunds

11.1 Cancellation must be requested via Customer Portal. Notice periods may apply (e.g., 15 days for general services and 30 days for VPS/Cloud/Dedicated, unless otherwise stated).

11.2 Renewed/used services may not be refundable except where mandatory law applies.

11.3 Domains are generally non-refundable.


12. Limitation of Liability

12.1 To the maximum extent permitted by law, ELENDE shall not be liable for indirect, incidental, consequential damages, loss of profit, loss of business, or loss of reputation.

12.2 ELENDE’s aggregate liability for any claim relating to a Service is limited to the amount paid by Customer for that Service in the billing period immediately preceding the event, except where mandatory law requires otherwise.


13. Force Majeure

ELENDE is not liable for failures caused by force majeure events beyond reasonable control.


14. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Angola. The courts of Luanda shall have jurisdiction, unless mandatory rules require otherwise.
